Can Anyone Be Sued For A Credit Card Debt?
 

Can anyone be sued for credit card debt? Unfortunately yes, if you owe a debt and have been delinquent on your payments for a long period of time you can potentially be sued. The question is, will you be sued? A credit card company (or a company or individual buying your debt) has 20 years to bring the case to court. Young people are better targets for them than older people because they will usually assume a younger person has a decent job and will be able to pay. There are options available to you if you find yourself in this position. First, it is important to keep in mind that credit card companies are usually not the ones suing.

Debt collection agencies buy delinquent debt from credit card companies for pennies on the dollar, hoping they can collect from you. If they do decide to sue you, they will serve you with an order to appear in court. The WORST thing you can do here is not show up in court. Even if the companies lawyer does not show up (and 90% of the time in these cases they do not), you will have an automatic ruling against you in their favor. At this point you will be forced to pay, ordered by the court. Many times simply showing up in court will be enough to win because the case will be thrown out if they other party does not show, and you can not be sued again.

Believe it or not, collection agencies are in a very weak position when they try to sue someone. Most of the time they do not even have all of the information on your debt. Typically when an agency buys your debt, they will not receive all the information attached to that debt. They may know what you owe, and how long you have been delinquent, but rarely even what was bought with the credit card. You have a right to request that they show all documents proving that you owe such a debt, and a lot of times they will not have them. The case gets thrown out and you will never have to worry about it again.

Credit card companies themselves will rarely sue unless it is an enormous debt, and sometimes not even then. If you receive a phone call from lawyers, do not be alarmed. It is simply intimidation 90% of the time, and nothing is important until you receive a summons. Even after the fact, you still have a good chance of winning the case. There are so many people out there with delinquent credit card debt it would be impossible for companies to sue everybody anyway, so do not even worry about it at all unless you receive a summons.
